Terms of Service

These Terms of Service ("Terms") govern your use of the website thegrib.ee / thegrib.com (the "Site") and any purchase made through it. By placing an order, you agree to these Terms.

 

Section 1 — Who we are

The Site is operated by The Grib OÜ, a private limited company (osaühing) registered in Estonia under registration number 17542461, registered address Punane tn 18d, Lasnamäe linnaosa, Tallinn, Harju maakond, 13619, Estonia ("we", "us", "The Grib"). Full trader identification is available in our Legal Notice.

 

Section 2 — Products

We sell mushroom (mycelium) grow kits intended for home/hobby gardening use ("Products"). Product descriptions, images, and prices on the Site are as accurate as possible but do not constitute a legally binding offer until we confirm your order under Section 3.

 

Section 3 — How a contract is formed

Placing an order on the Site is an offer to purchase. A contract is concluded only once we send you an order confirmation email. We may refuse or cancel an order (e.g. stock unavailability, pricing error, suspected fraud), in which case you will be refunded in full.

 

Section 4 — Prices and payment

All prices are shown in EUR. The Grib OÜ is not currently registered as liable to VAT in Estonia, so no VAT is charged on the prices shown; this may change if we become liable to register (including under the EU One-Stop-Shop scheme for cross-border sales), in which case prices will be updated accordingly and the change will not affect orders already confirmed. Shipping costs are shown separately at checkout before you confirm your order. Payment is processed securely through the payment methods offered at checkout, at the time of order.

 

Section 5 — Delivery

We aim to dispatch orders within a few business days of order confirmation. Delivery times shown at checkout are estimates, not guaranteed deadlines, unless stated otherwise. Risk of loss or damage passes to you upon delivery to the address you provided, in accordance with the Estonian Law of Obligations Act (VÕS).

 

Section 6 — Right of withdrawal, cancellations and returns

Your right to withdraw from the contract, applicable exceptions for grow kits (living/perishable goods under Art. 16(d) of Directive 2011/83/EU), our voluntary 72-hour quality guarantee, and the cancellation process are set out in full in our Return Policy, which forms part of these Terms.

 

Section 7 — Statutory conformity guarantee

Independently of the above, you have a statutory 2-year right to a conforming product under Directive (EU) 2019/771 and the Estonian Law of Obligations Act. If a Product is defective or not as described at the time of delivery, contact us at gipsyshroom@gmail.com and we will repair, replace, or refund it in accordance with the law. This guarantee cannot be excluded or limited by these Terms.

 

Section 8 — Product use and disclaimer

Grow kits contain a living organism (mycelium) and require the buyer to follow the included care instructions. We are not liable for a failed harvest caused by handling, storage, or growing conditions outside our control, without prejudice to your statutory rights under Section 7 for defects present at the time of delivery.

 

Section 9 — Data protection

We process personal data in accordance with our Privacy Policy and the GDPR. Please refer to that policy for details on what data we collect and how we use it.

 

Section 10 — Complaints and out-of-court dispute resolution

If you have a complaint, please contact us first at gipsyshroom@gmail.com so we can try to resolve it directly. If we cannot resolve your complaint, Estonian consumers may refer the dispute free of charge to the Consumer Disputes Committee (Tarbijavaidluste komisjon), operated by the Consumer Protection and Technical Regulatory Authority (TTJA): address Endla 10A, 10122 Tallinn, Estonia; phone +372 667 2000; online submission via ttja.ee. Consumers resident in other EU member states may contact their national out-of-court dispute resolution body (a list is available via the European Commission's consumer redress pages). Note that the former EU ODR platform was permanently discontinued on 20 July 2025 and is no longer available.

 

Section 11 — Governing law and jurisdiction

These Terms are governed by the laws of Estonia. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence. Any dispute not resolved under Section 10 may be brought before the competent Estonian courts, without prejudice to your right as a consumer to bring proceedings before the courts of your own country of residence.

 

Section 12 — Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order applies to that order. We will post the updated version on the Site with a new "Last updated" date.
